Autre justification: The current total maximum value of FWC No.: 03/2022/EITPROC is EUR 2,200,000.00 for the 48 months total duration. The EIT reaches the current FWC ceiling (EUR 2,200,000.00) already in December 2025 the latest, after approx. after the first 29 months of FWC-performance. Therefore, it is needed to increase the ceiling of the current framework contract in order to ensure the business continuity for providing interim staff services at EIT’s meetings. The as per section
1. 7 of the Tender Specifications (page 18), within three years following the signature of the framework contract resulting from the Call for Tenders, the Contracting Authority reserves the right to conduct negotiated procedure without prior publication of a contract notice based on point 11.1.e of Annex 1 to the Financial Regulation (Regulation (EU Euratom) 2018/1046 of the European Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union) to procure new services from the contractors up to a maximum of 50% of the initial framework contract ceiling if such a need occurs and the respective conditions apply. These services would consist in the repetition of similar services entrusted to the contractors and would be awarded under the following conditions: lowest price. This is instrumented by a negotiated procedure under Point 11.1. (e), Annex 1 of the EU Financial Regulation, within three years following its conclusion and before the ceiling is reached, to supplement the framework contract by new services consisting in the repetition of the similar services. Taking into account the principle of proportionality, these new services should not account for more than 50% of the initial maximum budget. The negotiated procedure shall not have an impact on the maximum duration of 4 years as established above.
