The National Asset Management Agency (NAMA) has awarded a contract to the incumbent service provider for the continuation, customisation and maintenance of a bespoke portfolio management system, asset registry and receivers portal to facilitate the day to day management of NAMA's reducing loan assets and of any collateral (real estate and non-real estate). The term of the contract shall be for the remaining lifetime of NAMA, in so far as it is needed, where NAMA's ultimate wind is anticipated to be 2025. |

The award of the contract without prior publication on OJEU to the service provider, Fenergo Ltd ('Fenergo'), is considered lawful as it is in accordance with the exceptions outlined under Regulations 32(2)(b)(ii). In the particular circumstances, competition is absent for technical reasons. The maintaining of the PMS is essential for NAMA's day to day operations and it is critical that NAMA does not experience a disruption in these services as it winds down its operations. The existing system requires adaptation to facilitate NAMA's wind-down and the incumbent, given its knowledge and experience in building this bespoke system is demonstrably best placed from a financial and technical position to provide these services. To adapt a new system and bringing in a new supplier with no prior knowledge at this stage of NAMA's life-cycle cannot be justified without substantial and disproportionate costs and delays being incurred by NAMA, both of which would be to the detriment of NAMA's statutory mandate. |
