Justification for cancellation About the legal basis: Provisions on a contracting authority's right to cancellation are regulated in the Public Procurement Regulations, § 25-4, which state that the contracting authority can cancel a contest with immediate effect if there is a justifiable reason. The contracting authority's duty to cancel follows set legal practice, where the basis is that a contracting authority has a duty to cancel a contest if an error has been made, and it can be proved that the contest could have had a different outcome if the error had not been made. It is the municipality's assessment that, in this case, there is both a right and a duty for the municipality to cancel the contest. Assessment and justification: Point
1. 4.7 of the tender documentation states that the contest would be decided on the basis of which tender had the best relationship between price and quality, with the evaluation being based on the criteria price, implementation ability, and environment. A review of the tenders has uncovered that the price criterium and the price sheet, as they are formulated in the tender documentation, are not suitable to identify the economically most advantageous tender. In concrete, the error was that multipliers were not included that show volume and need within each of the price elements. The error cannot be corrected in any other way than by a cancellation and the publication of a new contest, and the municipality has, thus, a duty to cancel the contest.
